Course Description: The Basic Civil Process course covers the civil jurisdiction of courts, officer’s responsibilities, the rules and
codes that govern the service, execution and return of civil citations, writs, subpoenas and other documents. Per TCOLE Rule 218.3(d), Deputy Constables must take Civil Process (#3131) each cycle.
This 20-hour Texas Commission on Law Enforcement (TCOLE) Basic Civil Process Course (#3131) provides peace officers with the fundamental knowledge and skills required to safely, effectively, and lawfully execute civil process within the State of Texas. The course delves into the intricate legal framework governing civil process, ensuring officers understand their authority, responsibilities, and limitations. Participants will gain a comprehensive understanding of various types of civil writs and orders, proper methods of service, documentation requirements, and the unique challenges and liabilities associated with civil process duties. This course is essential for officers new to civil process responsibilities or those seeking to refresh their understanding of these critical functions.
Topics covered in the course includes Occupations Code and Commission Rules, Criminal Justice System, Civil Process, Post Judgment Writs, Landlord Tenant, Tax Foreclosure Suits, Protective Orders.
Target Audience: This course is specifically designed for Texas Peace Officers whose duties include or will include the service and execution of civil process. This includes, but is not limited to, patrol officers, deputies assigned to civil divisions, and supervisors overseeing civil process operations.
